Terms of Service

By creating an account or using any ZidiMail service (the "Service"), you agree to these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree, do not use the Service.

ZidiMail provides a transactional email delivery API, a web dashboard, and related tools that allow you to send email programmatically using your own verified sending domain. The Service is operated by ZidiMail ("we", "us", or "our").

You must be at least 18 years old to use the Service. You must provide accurate registration information and keep it up to date. Accounts are not transferable without our prior written consent.

Your use of the Service must comply with our Acceptable Use Policy, which forms part of these Terms. In summary, you must not send spam, phishing, or illegal content; must not abuse rate limits or security controls; and must only send from domains you are authorized to use.

You are responsible for all email sent using your verified domains and API keys. You must own or have authorization to use any domain you add to the Service. Sending from domains you do not control is prohibited and may result in immediate account suspension.

You are responsible for maintaining the confidentiality of your API keys and account credentials. You must notify us immediately at legal@zidimails.com if you suspect unauthorized access to your account. We are not liable for any loss resulting from unauthorized use of your credentials.

Paid plans are billed on a monthly subscription basis via PayPal. Prices are listed on the pricing page and may change with 30 days' notice. Subscriptions renew automatically until cancelled. Refunds are handled at our discretion on a case-by-case basis. If payment fails, your account may be suspended until payment is resolved.

The Free plan is provided as-is with no uptime guarantee. We reserve the right to modify free plan limits or discontinue free access with reasonable notice.

The Service, including all software, designs, trademarks, and content, is owned by ZidiMail and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights. You retain ownership of all content you send through the Service.

Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. We store email delivery logs to provide analytics and support. We do not sell your data. Where we process personal data on your behalf as a processor, our Data Processing Addendum applies when executed or when incorporated by reference as described therein.

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or emergency changes at any time. We are not liable for any loss caused by downtime or service interruptions.

To the maximum extent permitted by law, ZidiMail's total liability to you for any claim arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim. In no event shall ZidiMail be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data loss.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that emails will be delivered or that delivery rates will meet any specific threshold.

You agree to indemnify and hold harmless ZidiMail and its officers, directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

Either party may terminate these Terms at any time. We may suspend or terminate your account for any violation of these Terms. Upon termination, your right to use the Service ends immediately. We may retain data as required by law or legitimate business purposes.

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the dashboard. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by applicable law. Any disputes shall be resolved through binding arbitration or in a court of competent jurisdiction, as agreed by both parties.
